The Biden administration is appealing a district court ruling to force doctors to conduct gender transition procedures on children.
Oral arguments in the case were held Thursday morning in New Orleans, Louisiana.
Following on from the Obama administration’s court case on “transgender empowerment,” which sought to force doctors to provide children with what the left calls “gender-affirming care,” the Biden administration is challenging The district court decided to ban the Obama-era rule.
The Franciscan Union, a Catholic health care system, challenge The rule was included in Obamacare because it “requires physicians and hospitals across the country to perform a gender transition procedure on any patient, including children, even if the procedure violates the doctor’s conscience and may harm the patient.”
“No medical professional should be forced to engage in controversial and irreversible gender transition procedures that can cause serious harm to patients,” Dr. Serious harm.” “The federal government is under no obligation to compel physicians to violate their conscience, professional medical judgment, and the Hippocratic oath to ‘do no harm.'”
The Biden Department of Health and Human Services, led by Secretary Xavier Becerra, is seeking to push for similar rule According to a press release from the Becket Fund for Religious Liberty — the religious liberty law firm that acted as legal counsel to the Franciscan Coalition in the case, such medical procedures will still be mandated , “or face severe financial penalties.”
The new proposed rules are somewhat vague about how far the Biden administration is willing to go in what they consider “gender-affirming care” for children.
However, the definition provided for “gender affirming care” in the proposed rule “may include, but is not necessarily limited to, counseling, hormone therapy, surgery, and other services designed to treat gender dysphoria or support gender affirmation or transition.”
Additionally, Assistant Health Minister Rachel Levine, a woman, called for increasingly younger “gender affirming care” to “affirm, support and empower these young people”.
Although the Biden administration has given high priority and advocacy to this issue, research programme Up to 94% of children (77-94% in one and 73-88% in the other) will naturally get rid of this anxiety. However, Biden’s transgender mandate would at least impair their ability to go through adolescence, preventing these kids from escaping that mandate.
“The Franciscan Union and Sisters of Eternal Worship St. Francis seek to continue the healing ministry of Jesus Christ by providing the best possible care for everyone who comes to our door,” said Sister Petra Nelson of St. Francis and Sisters of Eternal Worship and Franciscan Alliance board members said in a press release. “We are simply asking the court to let us continue to care for all of our patients with joy and compassion – as we have done for over 145 years.”
If the appeals court decides to uphold the district court’s injunction, doctors will continue to be protected from transgender mandates.
“We ask the court today that physicians continue to care for all patients with compassion, conscience, and common sense,” Joseph Davis, an attorney with the Beckett Foundation for Religious Freedom, said in a release. “We hope the courts will agree that transgender empowerment is a clear violation of federal law and the freedom of conscience of physicians.”
the case is Franciscan Union v BecerraNo. 7:16-cv-00108-O, U.S. Court of Appeals for the Fifth Circuit.
